Terms of Service

These Terms of Service govern the use of the PickupSelect service (pickupselect.com, its widget, API, dashboard and plugins). By creating an account or using the service you accept them.

PickupSelect provides a pickup point and parcel locker selector that online shops embed in their checkout: an embeddable map widget, an API, a dashboard for widgets, keys and statistics, and plugins (for example for WooCommerce). The pickup point data comes from the carriers' public sources and is updated regularly.

3. Business customers only

The service is offered only to businesses (companies, sole traders and other organisations acting in the course of their business). By signing up you confirm that you use the service for your business. Consumer protection rules that apply only to consumers, such as the right of withdrawal, therefore do not apply.

4. Account

• You must give true details and keep your login credentials and API keys confidential. You are responsible for everything done with your account and keys.
• API keys may only be used on the websites (allowed origins) set for them in the dashboard.
• You may close your account at any time by writing to us or, where available, in the dashboard.

5. Plans, fees and payment

• The plans, their limits (for example the number of widgets and daily requests) and their fees are shown on the website and in the dashboard. VAT is charged as required by law.
• Paid plans are billed monthly or yearly in advance, by card through Stripe, and renew automatically until cancelled. Invoices are issued electronically.
• If you cancel, the plan stays active until the end of the paid period and is not renewed. Fees already paid are not refunded, except where the law requires it.
• If a payment fails, we may limit the service to the free plan until it is settled.
• We will announce price changes at least 30 days in advance by email. The new price applies from the next billing period after that; you may cancel before it takes effect.
• When the daily request limit of the plan is reached, the widget stops serving requests until the limit resets (at 00:00 UTC). Our plugins then hide the pickup point option so that the shop's checkout keeps working.
• We may change or end the free plan with 30 days' notice.

6. Acceptable use

• Use the service only lawfully and for selecting pickup points in your shop's checkout or similar purposes.
• Do not overload, scan, attack or reverse engineer the service, and do not copy, resell or redistribute the pickup point data in bulk.
• Tell your own customers in your privacy notice that your checkout uses PickupSelect (see section 10).
• Your contracts with carriers (shipping, prices, parcel sizes) are your own; PickupSelect is not a carrier.

We may suspend access immediately if the service or other customers are put at risk, or in case of a serious breach; otherwise we will warn you first.

7. Pickup point data

We take care to keep the data up to date, but we cannot guarantee that every point exists, is open or accepts a given parcel at any given time: carriers change their networks and their data may be incomplete.

8. Availability

We aim to keep the service available at all times, but we do not guarantee uninterrupted availability. Maintenance may cause short interruptions; we try to schedule it for quiet hours.

9. Liability

• Our total liability under these terms is limited to the fees you paid us in the 12 months before the event that caused the damage.
• We are not liable for indirect damage, lost profit, lost orders or data, or for the carriers' data and services.
• These limits do not apply to damage caused intentionally or by gross negligence, or to damage to life, body or health, or where the law does not allow limiting liability.

10. Data processing for your customers

When your customers use the widget, we process some of their personal data on your behalf, as your data processor under Article 28 of the GDPR. You are the controller of that data. This section is our data processing agreement:

• Data and purpose: IP address, browser details, the page address, the browser language, the searched address or postal code, the approximate location shown on the map, and the selected pickup point, processed to show and select pickup points, to keep the service secure and to give you usage statistics.
• Duration: as long as you use the service. The IP address and browser details of a selection are deleted after 30 days, the statistics after 13 months, server logs after 14 days, backups after at most 6 months.
• We process the data only on your instructions (these terms and your settings), keep it confidential, protect it with appropriate technical and organisational measures, help you answer data subject requests, notify you of a personal data breach without undue delay, and delete it when the service ends.
• You authorise the sub-processors listed in our Privacy Policy. We will announce new sub-processors there at least 30 days in advance; you may object or close your account. Where data leaves the EU, it is protected by an adequacy decision or the EU standard contractual clauses.
• On request we provide the information needed to show compliance with these obligations.

11. Intellectual property

The service and its software belong to us; you get a non-exclusive right to use them while your account is active. Our plugins are free software under their own licence (the WooCommerce plugin: GPL-2.0-or-later).

12. Term and termination

The agreement runs for an indefinite period. You may end it at any time by closing your account. We may end it with 30 days' notice, or immediately in case of a serious breach or non-payment.

13. Changes to these terms

We may change these terms. We will announce changes at least 30 days in advance by email and on this page. If you do not agree, you may close your account before they take effect; continued use means acceptance.

14. Governing law and disputes

These terms are governed by Hungarian law. Disputes are decided by the Hungarian court competent for the registered office of Onlinex Solutions Kft.
